I’m using 400error.htm, 403error.htm, 404error.htm and 500error.htm pages on my site to deal with user errors.

(I also have a .htaccess file to facilitate this.) These error pages are all exact copies of my home page, so whatever the user does, they will end up seeing my home page if they make a mistake. What concerns me is, will I incur any duplicate content penalty (with Google or any of the search engines) because of this, and will my rankings suffer as a result?
